Upon reading and filing the petition of Charles D. Carter, claiming to be entitled, by virtue of a certain contract in wilting, made by the said Jam' s Van tine in his lifetime, to a conveyance 0 certain Real Estate particularly described in said petition, setting forth the facts upon which said claim is predicated, and praying for a decree authorizing and directing A. 11. litoomb, the Executor of the last Will and Testament of said James Van tine, deceased, to execute a conveyance of said Real Estate. It is hereby ordered by the Judge of the said ? robate Court, that MONDAY, the third day of June, 1867, at eleven o'clock in the forenoon of said day, being at a regular term, to wit: at the June term.
