THE BATAVIA'S CHINESE.

The Clash Between the, Cu.toma Officials » and the Federal Court*. When the time came yesterday for the issuance of papers clearing the steamship Batavia for Hongkong, the Custom House officials refused to clear her, as there were on board eighty-five Chinese out of the 122 that arrived on her that had not yet been examined as to their right to land. Soon after, Judge Sabin issued an order to United States Marshal Franks "to proceed at once to 'the steamship Batavia, about to clear from this port, : and cause to be executed and returned to Court all writs of habeas corpus issued out of the United States Circuit Court '""or but of the United States District Court for the Northern District of California fo* persons now detained on said ship. You will cause all persons named in said .writs to be at once removed from said ship and brought into Court,' and you will arrest any and all persons obstructing or attempting to obstruct the . master of said ship or any of his officers or servants in the execution of said writs of habeas . corpus, or who may obstruct or attempt to obstruct," hinder or prevent you in the execution of this order." Marshal Franks -went down to the Oceanic Dock and. told Inspectors Grant and Critcher, tbe Customs officers in charge ol the Batavia, that those Chinese had to land in obedience to the \ writs whether they had been examined by them or not, and if any one stopped or interfered with them he would : ar-' rest . them. Thereupon , the; Inspector ; stood aside' and , the Chinamen with their luggage were carted ■ up to the Appraisers' building, where they were.discbarged on bonds pending the time they will wait for a-hearine.- In the meantime tbe prior residents 'among them will have '*. a chance to cram ; up 7 on the localities about the city, and be prepared to answer how. many feet of snow, lay on the ground here every" Winter, and ' whether ra' cable road . is operated by horses or mules. - Collector Hager, has communicated the above facts to the United States District Attorney's ? - office ; to : be • forwarded to Washuigton.\ The Batavia secured her clearance papers later in the day,' and thus ended the conflict of power for the present.
