Baxter told me he lent bis pistol to Getchell &lt;b class="highlightcolor"&gt;the&lt;/b&gt; night of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; homicide. &lt;b class="highlightcolor"&gt;The&lt;/b&gt; &lt;b class="highlightcolor"&gt;prosecution&lt;/b&gt; here rested. &lt;b class="highlightcolor"&gt;The&lt;/b&gt; opening statement of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; &lt;b class="highlightcolor"&gt;defense&lt;/b&gt; was then made by C. F. McGlashan. B. CARUTHKR3, VICE PRESIDENT OF &lt;b class="highlightcolor"&gt;THE&lt;/b&gt; LEAGUE, SWORN. Nothing unusual occurred &lt;b class="highlightcolor"&gt;the&lt;/b&gt; night of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; homicide ; no committees were appointed ; no volunteers called &lt;b class="highlightcolor"&gt;for&lt;/b&gt; to notify &lt;b class="highlightcolor"&gt;the&lt;/b&gt; millmen ; no speeches , Ford made no speech ; no action was taken contemplating &lt;b class="highlightcolor"&gt;the&lt;/b&gt; scaring of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; Chinamen; nobody rose as volunteers; was about tbe last to leave &lt;b class="highlightcolor"&gt;the&lt;/b&gt; League; no men remained; Thomas Ford, Secretary of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; League since &lt;b class="highlightcolor"&gt;the&lt;/b&gt; organization, remained until &lt;b class="highlightcolor"&gt;the&lt;/b&gt; close; made no speech calling tor volunteers to notify tbe milimen ; &lt;b class="highlightcolor"&gt;the&lt;/b&gt; Constitution prohibits such measures; I deny &lt;b class="highlightcolor"&gt;the&lt;/b&gt; statement of McCuliough, Getchell and McCuen regarding &lt;b class="highlightcolor"&gt;the&lt;/b&gt; League. OTHE2 EVIDENCE. Robert Swain corroborated Caruthers and Ford. Ha'nlet Davis explained &lt;b class="highlightcolor"&gt;the&lt;/b&gt; objects of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; League, and corroborated substantially &lt;b class="highlightcolor"&gt;the&lt;/b&gt; previous witnessesA. M. Walker met McCullougb ten minutes after &lt;b class="highlightcolor"&gt;the&lt;/b&gt; League closed, in front cf Hurd's saloon ; is positive in bis contradiction of McCullougb, Getchell and McKeon. Benjamin Love, sworn. — Never beard of a committee being appointed ; never beard of volunteers ; did nut volunteer myself ; after &lt;b class="highlightcolor"&gt;the&lt;/b&gt; adjournment went immediately uowu stairs ; did not remain in tbe ball ; was sick that night. F. 11. Doan corroborated &lt;b class="highlightcolor"&gt;the&lt;/b&gt; evidence concerning tbe League; after &lt;b class="highlightcolor"&gt;the&lt;/b&gt; adjournment saw Getchell in Andy Johnson's saloon; appeared intoxicated; Cross subpeuaed me a'- Boca &lt;b class="highlightcolor"&gt;for&lt;/b&gt; &lt;b class="highlightcolor"&gt;the&lt;/b&gt; &lt;b class="highlightcolor"&gt;prosecution;&lt;/b&gt; told Cross when subpenaed that a month before &lt;b class="highlightcolor"&gt;the&lt;/b&gt; homicide heard a talk of sending a committee to wait on L. ED:;i , to ask him if he would discbarge his Chinamen if whites were rurnlsbed; no violence was to be used. Witness was here questioned as to &lt;b class="highlightcolor"&gt;the&lt;/b&gt; difference between &lt;b class="highlightcolor"&gt;the&lt;/b&gt; Caucasian League and Order of Caucasians. Thomas Ford recalled by &lt;b class="highlightcolor"&gt;the&lt;/b&gt; &lt;b class="highlightcolor"&gt;prosecution&lt;/b&gt; — No similarity exists between &lt;b class="highlightcolor"&gt;the&lt;/b&gt; Lea-rue and Order of Caucasians ; &lt;b class="highlightcolor"&gt;the&lt;/b&gt; obligations are very different; nothing secret in &lt;b class="highlightcolor"&gt;the&lt;/b&gt; League but &lt;b class="highlightcolor"&gt;the&lt;/b&gt; pass words ; nothing in &lt;b class="highlightcolor"&gt;the&lt;/b&gt; oath to prevent witness telling &lt;b class="highlightcolor"&gt;the&lt;/b&gt; truth. , W. H. Slade, sworn— Wa3 with Mershon in &lt;b class="highlightcolor"&gt;the&lt;/b&gt; League ; went down stairs together immediately afte r adjournment; talked in front of Hard's Hall ten or fifteen minutes ; walked with Mershon almost home ; Mershon did not remain in &lt;b class="highlightcolor"&gt;the&lt;/b&gt; hall. E. J. Mulligan, sworn— Getchell came into Johnson's about half past ten o'clock on &lt;b class="highlightcolor"&gt;the&lt;/b&gt; night of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; &lt;b class="highlightcolor"&gt;murder,&lt;/b&gt; and stayed until, about 1 o'clock; was drank and boisterous, singing and carousing; disturbed a game in &lt;b class="highlightcolor"&gt;the&lt;/b&gt; club room ; am positive it was &lt;b class="highlightcolor"&gt;the&lt;/b&gt; night of &lt;b class="highlightcolor"&gt;the&lt;/b&gt; &lt;b class="highlightcolor"&gt;Trout&lt;/b&gt; &lt;b class="highlightcolor"&gt;creek&lt;/b&gt; &lt;b class="highlightcolor"&gt;murder.&lt;/b&gt; This witness was corroborated by W. H. Lane aDd Frank Marsen. Leonard Cody, swora— Saw Getchell at 10:15 on &lt;b class="highlightcolor"&gt;the&lt;/b&gt; night ct &lt;b class="highlightcolor"&gt;the&lt;/b&gt; &lt;b class="highlightcolor"&gt;murder,&lt;/b&gt; in Johnson's ; walked across to Moody 's Hotel with (ietchell ; he had been drinking ; slept in &lt;b class="highlightcolor"&gt;the&lt;/b&gt; barn with Getchell; he came in about 2 o'clock ; sUgsered as if drunk ; Getcheil was discharged th 3 Tuesday following ; am positive about tbe dates. Witness corroborated as to &lt;b class="highlightcolor"&gt;the&lt;/b&gt; time Getcbell entered tbe barn by Alexander Johnson. * T. 11. Baxter was told by Getcbell on &lt;b class="highlightcolor"&gt;the&lt;/b&gt; 18th that if a reward nas cOered he would get some of it. ii. Frank, sworn — Getchell told me on Wednesday, &lt;b class="highlightcolor"&gt;the&lt;/b&gt; 20: h, thai he would make money out uf tue Caucasian League, and had a pander. Hash McLean, sworn — Gstchell told me he and Feelers were go eg to b« arrested &lt;b class="highlightcolor"&gt;for&lt;/b&gt; &lt;b class="highlightcolor"&gt;the&lt;/b&gt; Ireul &lt;b class="highlightcolor"&gt;creek&lt;/b&gt; &lt;b class="highlightcolor"&gt;murder;&lt;/b&gt; asked me to swear I was with vim all that High', six days after &lt;b class="highlightcolor"&gt;the&lt;/b&gt; &lt;b class="highlightcolor"&gt;murder.&lt;/b&gt; Tbe CUrt adjourned. lion.
