APRIL TERM. Sealem. Greer [No. 1.404J.— By the interlocutory judgment it was ordered " that there oe set off to the said several parties such portions of said premises as will include their respective improvement?; provided, always, that the rights or interests ot neither of tbe other parties be prejudiced thereby; and that there be set off to the said Henry W. Scale his share or interest upon tbe south side of said rancho, in such manner as to include his improvements, provided that the same can be done without prejudice to the rights of any of the others in Interest" Counsel for the defendants have cited many authorities to prove that the first portion of the order is equitable, just and proper ; but the proposition is not doubted by the other side, and cannot be successfully assailed. Tbe question presented is, whether the Commissioners have erred in the application of the rules laid down In the interlocutory judgment. No error appears on the lace of their report, and, as none will be presumed, the report ought not to be set aside, unless tbe parties excepting to it show such a state of facts as will make the atleaed error affirmatively and clearly appear. It is not shown that tbe tract of laud allotted to defend Mercier is not equal In value to his share of the whole rancho. It is not alleged that the tract set off to him does not Include his improvements, but he complains that ths tract set off to toe Seasons was not located on lands in bis (Mercier's) possession. The Seatons have not complained of the partition, and MerciT is not entitled to except to the report on their beh ilf. The fact that litigation was penning between him and the Beacons respecting the title, under which they claim, does not give him any right to act for hem; for the interlocutory judgment ascertained and fix-d the rients of tbe several parties in the lands, and such determination, whatever may be the result of the litigation alluded •, is conclusive in this partition. it i* alleged that Mrs. Greer's share should have been set off so as include all of her improvements. No complaint is made thai the value of tbe tract! allotted to her is not equal to the value of her interest in the whole ranch. No facts are stated by her, or are shown by the affi lavlts presented by her, going to prove that the tr^ct she now wishes set off to ber eoull nave been allotted to her without producing injury to her co-ten-ants. There is the general statement that her share could have been set off to her a.- she now desires without injury to the other parties, but this is denied by the other" side. Had her s-hare been set off, as she now demand-, it clearly would bave interfered wiih the location of the plaintiff's share at the south side of tbe rancho, as ordered by tbe interlocutory judgment. Tba tract at the northeastern portion of the rancho was set off to ber, so as to include a house and Improvements formerly ii her possession ; and ibis was done, as one of the Comnissiooers testifies, at her request, made through her husband. Her husband denies that he made such request, but we could not say that the Court erred in riving the greater credit to the statement of the Commissioner. And so ot the tract at the em'oarcadero. Both Mrs. Greer and the plaintiff claimed to be in possession of tbe tract, but the Commissioners found that the plaintiff was in the possession and allotted it to him. The Commissioners found it impossible to allot the portion either of Mrs. Greer or the plaintiff in one compact body, and the plat very plainly shows that the lands allotted to tbe plaintiff arc quite as inconvenient in i.rm as those allotted to Mrs. Greer. A considerable portion ol the lands allotted to the pUiniiff are situated at the northern side of the rancho, and it ii but ■'*' a* '" ° ; to presume, in the absence of evidence to the contrary, tbat neither the lands allotted 'o th» plaintiff nor those to Mrs. Greer could have been Bet off in otter portions of the rancho without injury to t'je interests of the other tenants in common. The statement that the lands are not so set off is to include In the portion allotted to anyone of the parties all of his or her improvements, is not sufficient ground for setting aside the report ; but it should have been further shown that the allotment could hive been so made as to include in the portion of either more ol bis or her improvements without injury to the rights or inter- ol the others. A rehearing having been granted In this cisc, the mo?t important questions now argued are whether the track complained of is a switch and turnout within the meanlug of the Act granting the franchise? (Laws ISB2, 412, Sec. 1.) And, if so. whether it la proper and necessary? The second definition of the word " turnout," ia the last edition of Webster's Dictionary, is "A short .side-track on a railroad, which may be occupied by one train while another is passing on a main track; a shunt, a-siding." And a "shunt" is defined "A turnoff to a -i '•■ or short rail, that the principal rail may be left free." Now. the trick in question exactly fills these definitions. It is a short track at the side of the main track, and connected with it by a switch, and used for the cars from the "Lone Mountain" branch of the road to pass on to, and stands in front of the company's office ; while the cars on tbe main road, running to Brannan street, pass and stop to allow the passengers going towards or Irom Lone Mountain to chanu* cars. Potter, an engineer, acquainted with the meaning of terms pertaining to railroads, testifies tbat " this is a switch, turnout Of side-track; the three constitutes turnout." And other engineeis and witnesses agree with bim. There is no testimony to the contrary.
