Justice Schauer Retires

SAN FRANCISCO (UPD—Ju« tice B. Rey Schauer announced today that he will retire from the California Supreme Court Sept. 15 after 37 years of judicial service. The retirement of Schauer, 73 a Republican, will give Gov. Edmund G. Brown an opportunity to appoint his fifth justice to the seven-man bench. Schauer's retirement was, in effect, forced by a law which should cut in half his pension if he retires at a later date. By retiring now, Schauer will be entitled to draw 75 per cent of his $32,000 annual salary. Two v.’pelfs ago. Chief Justice Phil S. Gibson, confronted with the same law also announced his retirement. Gov. Brown nominated Justice Roger J. Traynor to succeed him as chief justice and Atty. Gen. Stanley Mosk to take Traynor’s place as associate justice. Schauer was made a Los Angeles Superior Court judge in 1927 by the late Gov. C. C. Young, a Republican. The late Gov. Culbert L. Olson. a Democrat, promoted him to the state District Court of Appeal in Los Angeles in 1941 and appointed him to the Supreme Court in 1942.
